ASSIGNMENT #1: TORTS HYPOTHETICAL’S

In our daily lives, individuals are expected to behave and act in a particular manner that does not violate others’ rights. Every individual is accountable for their actions. The tort law’s main aim is to ensure relief to the injured parties; it also imposes liability to the individual that caused the harm. Tort law focuses more on the compensation of the plaintiff rather than punishing the defendant. However, some actions provide the basis for the individual to be penalized in both tort law and criminal liability (“Introduction To Tort Law”). Wade Garrett from Gabby’s pub has the right to sue both Jack Daniels and Tony Montana. Wade can sue Jack Daniels for negligence that caused him to be hit by Tony Montana’s car. Jack Daniels randomly left a bottle outside that blindsided Wade Garrett, causing him to stumble onto King Street and was hit by a car.

Wade Garrett can sue Tony Montana for assault since Tony pulled out a weapon on him and threatened him with words. The act of pulling out a weapon could have had severe consequences and mental distress on wade afterward. Tony Montana can sue the Gila monster owner for strict liability under tort law even though the pet Walker lets the dog lose (Henderson and Twerski). The angry mob can also be sued for battery under the tort law for stabbing Tony using a Ginsu knife to cause death.
