Legal Aspects in Health-Care

The case centers on Sanfiel, a psychiatric nurse, who had his license suspended due to disclosure patient information. He was understanding that the information he released was confidential and still released to unauthorized personas.

Clinical error and malpractice cases are on the rise and a critical aspect of medical negligence. According to Oyebode (2013), medical malpractice is contributing to spiraling costs both to society and the healthcare system at large. In this case, Gwendolyn, the victim of medical negligence, appears to be misdiagnosed, leading to death. The specific legal issue under consideration for this case is medical negligence. Gwendolyn first sought medical attention from two health professionals (Dr. Dorough, BCH Hospital, and Dr. Vance and Dr. Falk) who provided conflicting reports leading to Gwendolyn's death. This conflicting report from the different medical professionals shows that the case is a legal issue based on medical negligence.

Question 2

The court determined and ruled that the plaintiffs be awarded damages amounting to $1.5 million against Dorough. The jury appears to have ruled in favor of the plaintiff based on the testimonies presented by the two medical professionals, Dr. Vance and Dr. Falk, who also outnumbered Dourough's single witness, Dr. Dupuis. The magnitude of evidence presented before the jury appears to have led to the ultimate ruling in favor of the plaintiffs.

Question 3

Professionalism may apply as a legal issue regarding the above case of Gwendolyn.
